Infringement procedure

The Commission is responsible for ensuring that all EU countries properly apply EU law. The Commission takes steps if an EU country:

  • does not fully incorporate a directive into its national law by the set deadline
  • does not apply EU law correctly

In these cases, the Commission first works with the country concerned to address the issue. If this is unsuccessful, the Commission may start formal infringement proceedings against the country in question.
